How the New Hemp Rules Affect Gummies, Pre-Rolls & Drinks

Let’s break down what the new rules really mean for popular hemp products:

GUMMIES

Most gummies on shelves today have 5–10mg THC per piece.
Under the new federal rule? You get 0.4mg per package.
That’s not even one crumb of a gummy bear.

→ Translation: traditional hemp “THC gummies” are going away unless reformulated.

DRINKS

THC seltzers and THC mocktails have exploded the last two years — and the feds noticed.
Most contain 2–10mg THC per can.
Again: way above the limit.

→ Expect a massive contraction of the THC drink market by 2026.

PRE-ROLLS / THCA FLOWER

Since THCA also counts as “total THC,” federally:

  • THCA flower = no longer protected hemp

  • Many pre-rolls = reclassified out of hemp

→ This is basically a shutdown of the THCA flower loophole unless states carve exceptions.
