the go easy guide to the

federal hemp ban.

Plain English. No lawyer voice.

the short version

  • What

Congress rewrote the legal definition of hemp. Most THC products sold as hemp, including gummies like ours, won't fit it anymore.

  • When

December 11, 2026 for most products. Fully synthetic cannabinoids get cut off first, on November 12.

  • Right now

The current rules still apply until then. Nothing has changed yet for gummies like ours.

how we got here

  1. 2018

The Farm Bill makes hemp legal if it has 0.3% delta-9 THC or less by dry weight. Hemp gummies take off.

  2. Late 2025

A new law redefines hemp, with the change set for November 12, 2026.

  3. Sept 2026

A government funding bill, H.R. 6500, pushes most of it back to December 11.

  4. Nov 12, 2026

Fully synthetic cannabinoids lose hemp status. The delay never covered them.

  5. Dec 11, 2026

Everything else kicks in, unless Congress acts first.

what actually changes

  • All THC counts

The old test looked at delta-9 THC. The new one looks at total THC, including THCa and delta-8.

  • 0.4mg per container

One Vibe gummy has 5mg. The new limit for the entire bag is 0.4mg.

  • No lab-made cannabinoids

Cannabinoids that are synthetic, or made outside the plant, are out.

but wait

Is this a ban on all cannabis?

No. This is about hemp products. State-licensed dispensaries run under state law, which is a separate system.

Is it legal to buy gummies today?

Under current federal rules, hemp products at or under 0.3% delta-9 THC by dry weight are legal. State rules vary, which is why we don't ship to Washington, Idaho, Kansas, Iowa or South Dakota.

Is this definitely happening?

That's where it stands. There are bills in Congress to delay it, repeal it, or regulate hemp instead of banning it. As of mid-October, they were all still in committee, and the White House has reportedly said it won't back another extension. If anything changes, we'll update this page.

What about gummies I already have?

The law doesn't come with a clear answer for regular people yet. Products over the limit could be treated as marijuana under federal law after December 11, but no federal enforcement plan has been laid out. Your state's rules matter too. We're a gummy company, not your lawyer.

Does this affect CBD?

It can. Full-spectrum CBD products are in the mix because of the total THC limit. The FDA was also supposed to publish lists of cannabinoids and define "container," and as of mid-October it hadn't. So some of this is still fuzzy.

What about hemp flower?

It's affected too. The new test counts THCa as THC.

What about states with their own rules?

States run on their own timelines, and some are moving sooner. The federal date doesn't override state law in either direction.

What happens to Go Easy?

We're selling gummies until 12/11. After that, glass, pipes, lighters and merch aren't going anywhere. Neither are we.
